These Terms of Service ("Terms") govern your use of Tweaky ("Tweaky", the "App" or the "Service"), provided by LILYA LABS LTD ("Lilya Labs", "we", "us" or "our").
By downloading, installing, accessing or using Tweaky, you agree to these Terms. If you do not agree to them, you should not use the App.
Nothing in these Terms affects any rights you have under applicable consumer law that cannot lawfully be excluded or restricted.
Tweaky is a photo enhancement application developed by Lilya Labs. It provides tools for enhancing and improving photographs, including:

Prices and available plans may vary by country or region. The price shown in the App Store at the time of purchase is the price applicable to your purchase.
Tweaky Pro subscriptions purchased through the Apple App Store are billed and managed by Apple.
Subscriptions automatically renew at the end of each subscription period unless cancelled.
Apple may charge your selected payment method within 24 hours before the renewal date. You can manage or cancel your subscription through your Apple Account subscription settings. Cancellation takes effect at the end of the current paid subscription period.
Any refunds for purchases made through the App Store are handled in accordance with Apple's applicable billing and refund policies and your statutory consumer rights.
If we change subscription pricing, any change affecting your subscription will be handled in accordance with Apple's subscription rules and applicable law. Depending on the circumstances, Apple may notify you of the change or require your consent before the new price applies.
You must not use Tweaky to:
We may restrict, suspend or terminate access to Tweaky where we reasonably believe these Terms have been materially violated or where action is necessary to protect Tweaky, Lilya Labs, our users or others.
You retain ownership of the photographs and other content you submit to Tweaky.
You grant Lilya Labs the limited rights necessary to receive, process, temporarily store and return your content for the purpose of providing the Tweaky service.
We do not obtain ownership of your photographs merely because you use Tweaky.
Our handling, storage and deletion of personal information and uploaded images is further described in our Privacy Policy.
You are responsible for ensuring that you have the rights and permissions necessary to upload and process content using Tweaky.
Tweaky is designed, developed and engineered by LILYA LABS LTD.
Except for third-party software and other materials separately identified as such, Tweaky's proprietary software, application design, user experience, processing logic, workflows, branding and other Lilya Labs technology and intellectual property belong to Lilya Labs or its licensors.
You are granted a limited right to use Tweaky for your personal use in accordance with these Terms and the applicable App Store terms.
Except where permitted by applicable law or by the licence governing a third-party component, you must not copy, modify, distribute, sell, sublicense, reverse engineer, decompile or attempt to extract the source code of Tweaky or Lilya Labs' proprietary technology.
Tweaky is proprietary software developed by Lilya Labs and incorporates selected third-party technologies, including certain components made available under open-source licences.
Those third-party components remain subject to the rights and licence terms of their respective authors and licensors.
Applicable copyright notices, acknowledgements and third-party licence information for software distributed with Tweaky are available under:

Those notices relate to the separately identified third-party components and do not alter the ownership of Lilya Labs' proprietary software or other intellectual property.
Where there is any conflict between these Terms and the applicable licence governing a third-party component, the third-party licence governs that component.
We aim to provide a reliable service, but Tweaky may occasionally be unavailable because of maintenance, updates, technical problems, capacity limitations or circumstances outside our reasonable control.
We may change, update or improve features of Tweaky over time.
We do not guarantee that every feature will always remain available in exactly the same form.
Nothing in this section limits rights or remedies you may have under applicable consumer law.
Photo enhancement is affected by factors including the quality, content, resolution and characteristics of the source image.
Results may therefore differ from image to image and we do not promise that a particular enhancement will produce a specific visual result.
Tweaky is intended as a creative and photographic enhancement tool. You remain responsible for deciding whether an enhanced image is suitable for your intended purpose.
Nothing in these Terms excludes or restricts any warranty, right or remedy that cannot lawfully be excluded or restricted.
If you are a consumer in the United Kingdom, this includes applicable rights under the Consumer Rights Act 2015, including rights relating to digital content and services.
Subject to those rights, Tweaky is provided on an "as available" basis and we do not guarantee that the Service will always be uninterrupted, error-free or capable of producing a particular enhancement result.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
If we fail to comply with these Terms, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for loss or damage that was not reasonably foreseeable.
Tweaky is provided for personal and consumer use. If you use Tweaky for a commercial or business purpose, we are not responsible for business losses such as loss of profit, revenue, business opportunity or anticipated savings, except where applicable law provides otherwise.
Nothing in this section affects your statutory consumer rights.
We may develop, update, change or discontinue features of Tweaky from time to time.
Where a change materially affects a paid service you are currently entitled to receive, we will act reasonably and in accordance with applicable consumer law and App Store requirements.
We may change subscription prices from time to time.
Price changes will be implemented through the App Store and handled in accordance with Apple's subscription rules and applicable law.
Where Apple or applicable law requires notice or your consent before a price increase takes effect, that process will apply.
We may update these Terms where reasonably necessary, for example to reflect changes to Tweaky, applicable law, security requirements or our business.
Where a change materially affects your rights or obligations, we will provide reasonable notice where required.
Changes will not retrospectively remove rights that you have already acquired under applicable law.
If you do not agree to revised Terms, you may stop using Tweaky and cancel any subscription before its next renewal.
You may stop using Tweaky at any time.
You can cancel a Tweaky Pro subscription through your Apple Account subscription settings.
Removing the App from your device does not automatically cancel an active App Store subscription.
We may suspend or terminate access where you materially breach these Terms, misuse the Service, create a security risk, or where we are legally required to do so.
If Lilya Labs permanently discontinues Tweaky or a paid service, we will deal with existing subscriptions in accordance with applicable law and App Store requirements.
These Terms are governed by the laws of England and Wales.
If you are a consumer, this does not deprive you of any mandatory protections provided by the laws of the country in which you live.

We will try to resolve the matter directly with you.
Nothing in these Terms prevents you from using any court, dispute-resolution process or consumer remedy available to you under applicable law.
